Hazard Communication Standard (29 CFR 1910.1200) violations were the 3rd most frequently cited by OSHA in the agency’s 2011 fiscal year. The USEPA is also stringently enforcing compliance with its chemical-related programs (such as: CAA, CWA, RCRA, EPCRA and TSCA), with enforcement actions oftentimes exceeding $1,000,000.
With so many regulations derived from the type, quantity, use and storage of hazardous materials at your facility (e.g. Hazcom, PPE selection, PSM, CAA, CWA, RCRA and EPCRA), effectively managing chemicals is the key to chemical regulatory compliance. Although controlling the timing of a government agency inspection is usually not an option, you can take simple steps today to reduce your non-compliance risk.
The process for properly managing your chemicals and the risks they pose is a 5 step process:
1. Identify – What chemicals are used and how are they stored?
2. Assess – Which areas exhibit risk factors?
3. Define – Are your goals prioritized and concise?
4. Communicate – How will you get everyone on board?
5. Automate – Do you have a system to simplify compliance management?
