In what can perhaps be viewed as a “next step” for REACH, California is producing a regulation that will identify Chemicals of Concern (CoCs), and specific Priority Products (PPs) that incorporate those CoCs. Manufacturers of the PPs will be required to identify and assess potential alternative substances or designs that would replace or otherwise eliminate the CoC in their products. They would then issue a report detailing their findings to the California Environmental Protection Agency (EPA) Department of Toxic Substance Control (DTSC).
The regulation will require manufacturers to perform and document a formal “Alternatives Assessment” (AA) on their use of the CoC in the PP. The AA will be required to cover a wide variety of lifecycle impacts, but they are not calling it a Lifecycle Assessment.
The “A through M Criteria”, as they are being referred to are:
A. Product function / performance
B. Useful life
C. Materials / Resource consumption
D. Water conservation
E. Water quality impacts
F. Air emissions
G. Production, in-use, transport energy inputs
H. Energy consumption and efficiency
I. Greenhouse gas emissions
J. Waste and end-of-life disposal
K. Public health impacts: sensitive sub-populations
L. Environmental impacts
