Supreme Court handed down a decision in FAA v Cooper yesterday. Cooper did not declare his HIV positive status on his flight physical. At the time, the FAA had started cross-referencing SSI disability status with the pilot physicals, and they found he was getting disability due to his HIV status. So they fined him and grounded him because he falsified. This all occurred before we let HIV positive individuals fly (I have a couple in my practice). So The Supremes overturned a lower court finding that he sustained damages because the HIV status info was shared across agencies. Please read about it here:
